1. About ArbiterGG

ArbiterGG is a price tracking and arbitrage research tool for Pokémon Trading Card Game (TCG) collectors and traders. It is operated by an independent developer ("we," "us," or "our") and accessible at arbitergg.com. ArbiterGG aggregates publicly available price data from third-party sources to help users make informed buying and selling decisions.

ArbiterGG is a research and information tool only. We do not buy, sell, broker, or guarantee transactions involving Pokémon TCG cards or any other goods. All buying, selling, and trading decisions are made solely by you.

2. Eligibility

You must be at least 13 years of age to use ArbiterGG. By using ArbiterGG, you represent that you meet this requirement. If you are between 13 and 18 years of age, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

You must provide a valid email address and create a password to use ArbiterGG. You are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us promptly if you believe your account has been compromised

One account per person. You may not create accounts on behalf of others without their consent, use automation to create accounts, or share account access with third parties.

4. Subscription Plans and Billing

ArbiterGG offers the following subscription tiers:

• Free — basic search and watchlist access, subject to usage limits
• Hobbyist — expanded watchlist, additional features, billed monthly
• Pro — full feature access including estate sale leads, billed monthly

Paid plans are billed on a recurring monthly basis via Stripe. By subscribing, you authorize us to charge your payment method each billing cycle until you cancel. Prices are displayed at checkout and may change with 30 days' notice to active subscribers.

You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period; no partial-month refunds are issued. We reserve the right to offer refunds at our discretion on a case-by-case basis.

5. Acceptable Use

You agree not to use ArbiterGG to:

• Violate any applicable law or regulation
• Scrape, crawl, or systematically extract data from the ArbiterGG platform beyond normal app use
• Reverse-engineer, decompile, or attempt to extract source code from the service
• Circumvent feature gates, plan limits, or access controls
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the integrity or performance of the service
• Use the service for any fraudulent or deceptive purpose

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Price Data and Accuracy

Price data displayed in ArbiterGG is sourced from third-party APIs and marketplaces (including but not limited to PokeTrace and eBay sold comps). This data is provided for informational purposes only.

• We do not guarantee the accuracy, completeness, or timeliness of any price data
• Market prices fluctuate; data shown may be cached and not reflect real-time values
• ArbiterGG is not responsible for financial losses arising from reliance on price data displayed in the app

You acknowledge that any trade, purchase, or sale you make based on data from ArbiterGG is your sole decision and responsibility.

7. Estate Sale Leads Feature (Pro)

The estate sale leads feature surfaces publicly listed auction and estate sale events from third-party platforms. This feature is provided as-is. We do not vet, endorse, or guarantee any listings or sellers. ArbiterGG is not a party to any transactions originating from leads surfaced by this feature. Use your own judgment when attending or bidding on third-party sales.

8. Intellectual Property

The ArbiterGG name, logo, interface design, and original code are our intellectual property. You are granted a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes in accordance with these Terms.

Pokémon and all related names, characters, and card imagery are trademarks of Nintendo, Creatures Inc., and GAME FREAK inc. ArbiterGG is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or any related entity. Card names and set data are used for informational and interoperability purposes.

9. Disclaimers

ARBITER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF ARBITER. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of ArbiterGG, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We may suspend or terminate your access to ArbiterGG at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us or deleting your account through the app. Upon termination, your right to use the service ceases immediately.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of ArbiterGG after that date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Pennsylvania, and you consent to personal jurisdiction in those courts.
